spotted a vehicle behind them with the high beams on. The vehicle passed the
police vehicle and stopped at a red light with the high beams still on.
Officers initiated a traffic stop. The driver abruptly stopped and exited his
vehicle with his hands up. Officers ordered the driver back into his vehicle to
which the driver complied. Officers approached the driver and asked why he
stepped out the vehicle to which the driver replied with, “I’m sorry”. Officers
observed his blood shot eyes and asked if he had anything to drink. He
acknowledged he had some alcohol earlier. A field sobriety test was performed.
The officers determined the suspect was under the influence due to his poor
performance in the field sobriety test. The victim was transported to Mission
Station for further investigation. He was given a chemical breath test. The results showed that he was negative for
any alcohol. The officers determined that he was not under the influence,
